These Terms of Service (“Terms”) govern your use of the Activity Magic: Kids Activities mobile application (“App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
Activity Magic provides an AI-powered tool for parents and guardians: you take a photo of any real-world location (park, home, supermarket, museum, etc.), and the App generates creative, age-appropriate activity guides to entertain children in that specific environment. The App is offered “as is” for personal, non-commercial family use.
You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By using the App, you represent that you are a parent or legal guardian responsible for any child’s activities. The App is not intended for unsupervised use by children.
The activity guides are generated by artificial intelligence. While we strive for safety and creativity, you must review each suggestion before involving children. We are not liable for any injury, accident, or damages resulting from activities suggested by the AI. Always use common sense, check location safety, and adapt activities to the child’s age and abilities.
All rights, title, and interest in the App (including code, design, trademarks, and AI models) belong to Activity Magic. You retain ownership of the photos you take, but you grant us a limited, temporary license to upload and process those photos solely to provide the service (no permanent storage). The AI-generated activity text is owned by us, but you may freely use it for personal, non-commercial purposes with your children.
Our Privacy Policy explains how we treat your data. By using the App, you consent to the data practices described there, including the temporary processing of your photos.
The App is currently free to use. If we introduce paid features in the future, we will notify you and obtain proper consent via the App Store payment mechanism. Any such features will be governed by Apple’s terms as well.
We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time by deleting it from your device.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI SUGGESTIONS WILL BE ACCURATE, ERROR-FREE, OR SAFE IN EVERY SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ACTIVITY MAGIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA.
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be resolved through binding arbitration in San Francisco, CA, unless you opt out within 30 days of first use.
We may update these Terms. Material changes will be communicated via the App or by updating the “Effective date” above. Continued use means acceptance.
